Seeds In A Cup® is a trade name of Kevin Bruce LLC (“Seeds In A Cup,” “Company,” “we,” “us,” or “our”). This Legal Notice, Product Safety Disclaimer, and Assumption of Risk (“Notice”) applies to all products, kits, seeds, supplies, packaging, website content, instructions, promotional materials, and related services offered, sold, distributed, or otherwise made available by Seeds In A Cup®.
BY PURCHASING, RECEIVING, OPENING, HANDLING, USING, GIFTING, OR ALLOWING ANY OTHER PERSON TO USE ANY SEEDS IN A CUP® PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS NOTICE.
1. GENERAL USE; NOT A TOY
Seeds In A Cup® products are intended for lawful gardening, horticultural, decorative, educational, or novelty use only, as applicable. Unless expressly stated otherwise by us in writing on the specific product packaging, product page, or label, our products are NOT toys, are NOT intended for rough handling or unsupervised child use, and are NOT intended for human or animal consumption.
Children’s kits, educational kits, family kits, and similar products are intended only for supervised use by a parent, legal guardian, teacher, or other responsible adult. Adult supervision is required at all times whenever any Seeds In A Cup® product is used by or around minors.
NOT FOR CHILDREN UNDER 3 YEARS OF AGE.
2. SMALL PARTS; CHOKING; SWALLOWING; INHALATION HAZARDS
Products may contain seeds, pellets, soil pods, growing media, small tools, tags, clips, labels, plastic parts, decorative items, dried plant matter, packaging components, and other small or detachable materials that may present choking, swallowing, aspiration, inhalation, puncture, or other injury risks.
KEEP ALL PRODUCTS, COMPONENTS, PACKAGING, AND CONTENTS OUT OF THE REACH OF INFANTS, TODDLERS, UNSUPERVISED CHILDREN, AND PETS.
Do not place any product, seed, soil, plant material, or accessory in the mouth, nose, eyes, or ears. Do not allow children or pets to chew, swallow, inhale, lick, or otherwise misuse any product or component.
3. ALLERGIC REACTIONS; SENSITIVITY; BIOLOGICAL MATERIALS
Seeds In A Cup® products may contain or expose users to seeds, plant matter, roots, leaves, flowers, stems, husks, fibers, natural dyes, pollen, spores, fungi, soil organisms, mold, dust, minerals, fertilizers, amendments, packaging materials, adhesives, inks, coatings, or other natural, synthetic, biological, or agricultural substances.
ANY OF THESE SUBSTANCES MAY CAUSE OR CONTRIBUTE TO:
- allergic reactions;
- skin irritation;
- eye irritation;
- respiratory irritation;
- rashes;
- itching;
- sneezing;
- swelling;
- headaches;
- asthma or breathing discomfort;
- nausea;
- illness; or
- other adverse reactions.
If you, your child, or any person who may come into contact with the product has allergies, asthma, sensitivities, immune issues, plant allergies, pollen allergies, mold sensitivities, chemical sensitivities, or any other medical vulnerability, use extra caution and consult an appropriate qualified professional before use.
USE OF ALL PRODUCTS IS AT YOUR OWN RISK.
4. SPECIAL NOTICE FOR MYSTERY KITS
Mystery kits, surprise kits, assorted kits, sampler kits, and any kit sold without full advance disclosure of exact contents may contain a variety of seeds, plants, plant-related materials, soils, growing media, decorative items, accessories, and other components not specifically selected by the purchaser.
BY PURCHASING OR USING A MYSTERY KIT, YOU ACKNOWLEDGE, UNDERSTAND, AND ACCEPT THAT:
- exact contents may vary;
- contents may not be known by the customer before opening;
- different contents may create different allergy, sensitivity, choking, or handling risks;
- certain contents may not be suitable for all homes, children, pets, or individual users; and
- you assume all risk associated with unknown, mixed, assorted, or surprise contents.
If you require guaranteed ingredient, seed, plant, or component-specific screening for allergies, sensitivities, household safety, pet safety, child suitability, or similar concerns, DO NOT PURCHASE OR USE A MYSTERY KIT.
5. SPECIAL NOTICE FOR CHILDREN’S KITS, FAMILY KITS, AND EDUCATIONAL KITS
Any product marketed or presented as a children’s kit, kid kit, family kit, homeschool kit, school kit, classroom kit, or educational kit still requires active adult supervision and adult judgment at all times.
NO CHILDREN’S KIT IS INTENDED FOR UNSUPERVISED PLAY, UNSUPERVISED HANDLING, OR MOUTH CONTACT.
The supervising adult is solely responsible for:
- determining age appropriateness;
- reading all instructions and warnings;
- monitoring use;
- preventing ingestion, misuse, or unsafe handling;
- removing loose or damaged parts;
- keeping products away from younger children and pets; and
- deciding whether the product is appropriate for the child’s abilities, sensitivities, and environment.
6. INGESTION; POISONING; PET SAFETY
Do not eat seeds, soil, plant material, pellets, fertilizer, powder, decorative items, coatings, packaging, or any other product components unless the specific item is expressly identified by us in writing as edible after proper cultivation and preparation.
Raw seeds, treated seeds, mystery materials, soil, fertilizers, and plant matter may be unsafe if swallowed or improperly handled. Some plants and seeds may also be unsafe for pets.
If accidental ingestion, poisoning, skin exposure, eye exposure, or inhalation occurs, seek appropriate medical, veterinary, poison-control, or emergency assistance immediately.

For potential pet poison emergencies, contact your veterinarian or ASPCA Animal Poison Control at (888) 426-4435.
7. MOLD, FUNGUS, GERMINATION, PLANT BEHAVIOR, AND NATURAL VARIATION
Because seeds, soil, and plant materials are natural and biological products, performance may vary. Products may be affected by storage conditions, humidity, temperature, shipping conditions, user handling, mold, fungus, bacteria, pests, water quality, sunlight, and other environmental conditions outside our control.
Mold, fungus, or natural decomposition can occur in moist growing environments. Germination rates, growth rates, plant appearance, color, fragrance, texture, survival, and final results can vary significantly.
Except as expressly stated in any separate written policy posted by us, we make no guarantee regarding:
- germination;
- growth;
- flowering;
- edibility;
- harvestability;
- plant size;
- color;
- fragrance;
- longevity;
- survivability; or
- suitability for any particular use, person, home, classroom, or environment.
8. NO MEDICAL, PROFESSIONAL, OR LEGAL ADVICE
Nothing provided by Seeds In A Cup®—including website content, packaging, labels, customer messages, descriptions, blogs, social media content, or educational materials—constitutes medical advice, pediatric advice, allergy advice, veterinary advice, toxicology advice, legal advice, regulatory advice, or professional horticultural advice.
Any statements regarding product use, plants, seeds, children, pets, safety, or care are general informational content only and must not be relied upon as a substitute for advice from a qualified physician, allergist, pediatrician, veterinarian, toxicologist, attorney, or other licensed professional.
9. CUSTOMER RESPONSIBILITY FOR LAWS AND RESTRICTIONS
You are solely and exclusively responsible for knowing, understanding, and complying with all federal, state, local, territorial, municipal, school, daycare, HOA, landlord, and other laws, regulations, rules, restrictions, permit requirements, and safety standards applicable to your purchase, possession, receipt, storage, cultivation, transport, gifting, or use of any Seeds In A Cup® product.
We do not guarantee that any product is lawful, appropriate, or permitted in your jurisdiction, institution, building, home, or intended use setting.
10. NO LIABILITY FOR MISUSE OR FAILURE TO SUPERVISE
To the maximum extent permitted by law, Seeds In A Cup®, Kevin Bruce LLC, and our affiliates, owners, members, managers, officers, directors, employees, agents, contractors, suppliers, licensors, successors, and assigns shall not be liable for any claim, injury, illness, allergic reaction, respiratory issue, irritation, poisoning, choking incident, pet injury, child injury, death, loss, damage, or expense arising from or related to:
- misuse or improper use of any product;
- unsupervised use by a child or minor;
- failure to read or follow warnings or instructions;
- failure to keep products away from children or pets;
- ingestion, inhalation, skin contact, or eye contact;
- allergy or sensitivity reactions;
- mold, fungal growth, pests, or biological activity;
- the contents of mystery kits or assorted kits;
- storage conditions;
- transport conditions;
- environmental conditions;
- legal noncompliance by the customer; or
- any use of a product in a manner not expressly authorized by us.
11. ASSUMPTION OF RISK; RELEASE
By purchasing, opening, handling, gifting, or using any Seeds In A Cup® product, you knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with the product and its contents.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND AGREE NOT TO HOLD LIABLE SEEDS IN A CUP®, KEVIN BRUCE LLC, OR ANY OF OUR AFFILIATES, OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, LICENSORS, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, OR EXPENSES ARISING OUT OF OR RELATED TO ANY PRODUCT OR ITS USE, MISUSE, CONTENTS, OR HANDLING, EXCEPT TO THE EXTENT SUCH RELEASE OR LIMITATION IS PROHIBITED BY APPLICABLE LAW.
12. NO WAIVER OF OTHER PROTECTIONS
This Notice is in addition to, and not in limitation of, any protections, disclaimers, limitations of liability, indemnification obligations, arbitration terms, policies, or other rights available to Seeds In A Cup® under our Terms of Service, Privacy Policy, Return Policy, Shipping Policy, Seed Growth Promise, product packaging, or applicable law.

KEEP ALL DOGGIO™ / DOGGIO AND CATIO™ / CATIO PRODUCTS, CONTENTS, SPROUTS, PLANTS, SOIL, AND PACKAGING OUT OF REACH OF DOGS, CATS, AND ALL OTHER PETS AT ALL TIMES.
You are solely responsible for:
(a) determining whether any product is appropriate for your household, pets, and environment;
(b) preventing access by pets;
(c) supervising any use of the product in areas accessible to pets; and
(d) removing or securing all kit contents, packaging, and plant materials before your pet can access them.
If any pet may have chewed, swallowed, inhaled, licked, or otherwise been exposed to any Seeds In A Cup® product or component, immediately contact a licensed veterinarian or appropriate animal poison resource. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEEDS IN A CUP®, KEVIN BRUCE LLC, AND OUR AFFILIATES, OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, LICENSORS, SUCCESSORS, AND ASSIGNS DISCLAIM ALL LIABILITY FOR ANY PET INJURY, PET ILLNESS, PET DEATH, VETERINARY COST, ALLERGIC REACTION, INGESTION, CHOKING, OBSTRUCTION, TOXIC EXPOSURE, OR OTHER LOSS OR DAMAGE ARISING OUT OF OR RELATED TO DOGGIO™ / DOGGIO, CATIO™ / CATIO, OR ANY OTHER PRODUCT BEING ACCESSED, MISUSED, CHEWED, SWALLOWED, INHALED, OR OTHERWISE CONTACTED BY ANY PET.
ALL PRODUCTS MUST BE USED RESPONSIBLY AND, WHERE CHILDREN ARE PRESENT OR MAY ACCESS THE PRODUCT, ONLY UNDER DIRECT ADULT SUPERVISION. SEEDS IN A CUP PRODUCTS ARE NOT TOYS AND ARE NOT INTENDED FOR UNSUPERVISED USE BY CHILDREN.
